These Terms of Use ("Terms") govern your access to and use of the Song Zero application, website at song-zero.app, and related services (collectively, the "Service") operated by Lucid North LLC("Lucid North," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age and capable of forming a legally binding contract under the laws of your jurisdiction to use the Service. The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 18. The Service is currently available to users physically located in the United States only. You agree not to access the Service from outside the United States.
2. Account Registration
To access most features, you must create an account using a supported sign-in method (Google OAuth or magic-link email). You agree to:
- Provide accurate, current information.
- Keep your login credentials secure.
- Notify us promptly of any unauthorized account use.
- Be solely responsible for all activity under your account.
We may suspend or terminate accounts that violate these Terms, abuse the Service, attempt to evade tier limits (e.g., by creating multiple free accounts), or pose a security risk.
3. The Service
Song Zero generates curated playlists, written "blurbs," and a genealogy visualization for a user-submitted anchor track ("Generations" or "Runs"). Generations are produced using third-party AI models (including Anthropic Claude and Google Gemini) and metadata from third-party services (including Spotify).
AI-Generated Content Disclaimer. Generations are produced by automated systems and may contain inaccuracies, hallucinations, fabricated facts, misattributed quotes, or biographical errors, including with respect to living or deceased artists, bands, songwriters, producers, or other persons. Lucid North does not warrant the accuracy of any factual claim contained in a Generation. You are solely responsible for independently verifying any information before relying on, republishing, or otherwise acting on it. Lucid North expressly disclaims liability for any consequences arising from reliance on AI-generated content.
The Service does not host, stream, or distribute audio recordings, lyrics, artist photographs, album artwork, or other artist-owned media. Music playback is provided exclusively via embedded Spotify players that draw from playlists hosted on Lucid North's own Spotify account. Your use of any embedded Spotify content is subject to Spotify's terms of service.
4. Subscription Plans, Pay-Per-Run, and Caps
4.1 Subscription Tiers
We offer the following monthly subscription tiers, each with a usage cap measured per billing period:

4.2 Pay-Per-Run Credits
You may purchase one-time run credits without subscribing:

4.3 Cap Enforcement
Run caps are enforced atomically when you initiate a Run. Successfully-initiated Runs and completed Runs count against your cap. Runs that fail due to system errors do not count. Caps do not roll over between billing periods or windows. Unused subscription Runs expire at the end of each billing period.
4.4 Automatic Renewal — IMPORTANT
By subscribing to any paid tier, you authorize Lucid North, through its payment processor Stripe, Inc., to charge your selected payment method on a recurring monthly basis at the then-current price for your tier until you cancel. Subscriptions automatically renew at the end of each billing period without further action by you. The renewal date and amount are displayed in your account at /account and are also included in your initial subscription confirmation email.
This automatic-renewal disclosure is also presented in a clear and conspicuous form on the checkout page before you complete your purchase, and a confirmation email summarizing the renewal terms and cancellation method is sent to your account email after each successful charge.
4.5 Cancellation
You may cancel your subscription at any time through the Customer Portal accessible from your /account page (the same medium in which you enrolled). Cancellation takes effect at the end of the then-current billing period; you retain access until that date. No cancellation fees apply.
4.6 Refunds
- Subscriptions: Refund requests submitted within 24 hours of an initial subscription charge will be considered on a pro-rata basis at our sole discretion. Subscription renewals are non-refundable except where required by applicable law.
- Pay-Per-Run Credits: Credits are non-refundable once purchased. Unused credits do not expire but are forfeited if your account is terminated for breach of these Terms.
- Print Products: Refunds for printed merchandise (see §5.6) are governed by our Print Products Refund & Return Policy.
- All refunds are processed via Stripe to the original payment method.
4.7 Price Changes
We may change subscription prices or introduce new fees with at least 30 days' prior notice by email or in-app notification. Changes take effect at your next renewal. Continued use after the effective date constitutes acceptance.
4.8 Failed Payments
If a recurring charge fails, your subscription will enter a past_due status. You will retain access during a grace period set by Stripe (typically up to 3 days) before the subscription is automatically canceled.
4.9 Taxes
Prices are exclusive of any applicable sales, use, value-added, or similar taxes. You are responsible for all such taxes.
5. User Content, Public Archive, and Print Products
5.1 What You Submit
When you initiate a Run, you submit an anchor song (artist + title) and configuration parameters (collectively, "User Inputs").
5.2 What Is Generated
The Service produces playlists, blurbs, a genealogy visualization, and metadata (collectively, "Generations"). Generations are derived from your User Inputs but are produced by AI models and Lucid North's pipeline.
5.3 Public Archive Submission
Every successful Run is automatically submitted to the public Song Zero Archive curator queue for editorial review. By initiating a Run, you grant Lucid North a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable licenseto use, reproduce, display, distribute, modify, publish, and create derivative works of the Generation (including your User Inputs as embedded in the Generation) for purposes of operating, promoting, and featuring content on the public Song Zero Archive, on Lucid North's marketing channels, and as the basis for Print Products under §5.6.
The anchor song you submit (artist + title) will be publicly visibleif your Generation is selected for publication on the Archive. Editorial selection is at Lucid North's sole discretion. Not all Runs will be published. We may decline, edit, or remove any submission for any reason without notice.
5.4 Attribution
Featured Archive entries may be displayed without personally identifying you unless you separately consent in writing.
5.5 Your Representations
You represent and warrant that:
- Your User Inputs do not infringe any third-party copyright, trademark, right of publicity, or other right.
- You have all rights necessary to grant the license in §5.3.
- Your User Inputs do not contain unlawful, defamatory, harassing, or hateful content.
5.6 Print Products
Lucid North may make available, at additional cost, physical print products derived from your Generation (each a "Print Product"), such as printed copies of the genealogy visualization. Print Products are independent editorial works produced by Lucid North that reference artist and band names solely for historical and editorial purposes. Print Products are not authorized by, endorsed by, or affiliated with any artist, band, label, or rights-holder depicted, and Lucid North makes no representation of any such affiliation. Print Products are produced and fulfilled through third-party print-on-demand providers; your purchase is also subject to the provider's terms. Print Product pricing, dimensions, materials, turnaround times, and refund/return rules are disclosed at the point of purchase and in our Print Products Refund & Return Policy.
6. Acceptable Use
You agree not to:
- Use the Service to infringe intellectual property or violate any law.
- Submit malicious code, attempt to compromise the Service, or scrape the Service except via published APIs (none currently offered).
- Reverse engineer, decompile, or extract underlying models or prompts.
- Resell, sublicense, or commercially redistribute Generations except as expressly permitted under §7.2.
- Use the Service or any Generations to train, fine-tune, evaluate, or otherwise develop any machine learning model, foundation model, or AI system without Lucid North's prior written consent.
- Create multiple accounts to evade tier caps or pricing.
- Use automated means to submit Runs without our prior written consent.
- Use the Service to generate content targeted at minors under 13.
Violation may result in immediate suspension or termination without refund.
7. Intellectual Property
7.1 Lucid North IP
The Service, including all software, designs, logos, the "Song Zero" and "Lucid North" marks, the Vol. 1 editorial site, the genealogy visualization system, all Print Product designs, and all underlying models, prompts, and pipelines, are owned by Lucid North or its licensors and are protected by copyright, trademark, and trade secret law.
7.2 Your License to Use Generations
Subject to your compliance with these Terms, Lucid North grants you a non-exclusive, non-transferable, worldwide license to:
- Use Generations produced from your Runs for personal, non-commercial purposes;
- Share Generations on social media in promotional contexts with attribution to Song Zero; and
- Order Print Products of your Generation directly from Lucid North under §5.6.
For commercial use of Generations beyond the foregoing — including but not limited to sale, licensing, advertising, or redistribution — contact support@song-zero.app to request a separate written license.
7.3 Third-Party Content
Generations may incorporate or reference third-party metadata (e.g., Spotify track data) and third-party AI output. Such content is subject to the rights of its respective owners. Embedded Spotify players are provided pursuant to Spotify's developer terms.
7.4 Use of Third-Party Names and Marks
Artist, band, label, and song names referenced within the Service and within Print Products are used in their descriptive and editorial sense to identify the subject matter of historical research and commentary. Such uses are nominative fair use and do not imply endorsement, sponsorship, or affiliation.
8. DMCA / Copyright Complaints
If you believe content on the Service infringes your copyright, send a notice complying with 17 U.S.C. § 512(c)(3) to our designated agent:

A valid notice must include: (i) a physical or electronic signature of the rights owner or authorized agent; (ii) identification of the copyrighted work claimed to be infringed; (iii) identification of the allegedly infringing material and its location on the Service; (iv) your contact information; (v) a statement of good-faith belief that the use is unauthorized; and (vi) a statement, under penalty of perjury, that the information is accurate and you are authorized to act.
We will respond to valid notices and may remove allegedly infringing content. Repeat infringers' accounts will be terminated. You may submit a counter-notice complying with 17 U.S.C. § 512(g) to the same agent.
9. Third-Party Services
The Service integrates with Stripe (payments), Supabase (auth, storage), Resend (email), Google (OAuth), Spotify (metadata and embedded playback), Anthropic and Google (AI models), Vercel (hosting), Inngest (orchestration), and one or more print-on-demand providers (Print Product fulfillment). A current list of subprocessors is available at Subprocessors. Your use of these integrations is subject to those parties' terms and privacy policies. We are not responsible for third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." LUCID NORTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. AI-GENERATED OUTPUT MAY CONTAIN ERRORS, INACCURACIES, OR INVENTED FACTS. YOU USE THE SERVICE AT YOUR OWN RISK.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LUCID NORTH AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
LUCID NORTH'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL FEES YOU PAID LUCID NORTH IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow exclusion of certain warranties or limitation of certain damages. The above limits apply to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Lucid North from any claim, damage, loss, liability, cost, or expense (including reasonable attorneys' fees) arising out of (a) your User Inputs, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) your misuse of Generations or Print Products.
13. Termination
We may suspend or terminate your account at any time for breach of these Terms, suspected fraud or abuse, non-payment, or as required by law. You may close your account at any time. Sections 5.3, 7, 8, 10, 11, 12, 14, 15, and 16 survive termination.
14. Governing Law, Arbitration, and Class-Action Waiver
14.1 Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
14.2 Informal Resolution First
Before filing any claim, you agree to contact us at support@song-zero.app and attempt to resolve the dispute informally for at least 30 days. We will likewise attempt to resolve any claim against you informally before filing.
14.3 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitrationadministered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will be conducted in Ocean County, New Jersey, or by videoconference at the consumer's election. The arbitrator's award is final and may be entered in any court of competent jurisdiction.
Exceptions. The following are not subject to arbitration: (i) claims that may be brought in small-claims court if they qualify; and (ii) claims for injunctive or other equitable relief to prevent actual or threatened infringement of intellectual property.
14.4 Class-Action Waiver
You and Lucid North agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable as to any claim, that claim (and only that claim) shall be severed and brought in court; the remainder shall remain in arbitration.
14.5 30-Day Opt-Out
You may opt out of this Arbitration and Class-Action Waiver section by sending written notice to support@song-zero.app within 30 days of first accepting these Terms, including your name, account email, and a clear statement that you decline arbitration. Opting out does not affect any other provision of these Terms.
14.6 Forum for Non-Arbitrable Claims
For any claim not subject to arbitration, the exclusive venue is the state and federal courts located in Ocean County, New Jersey, and the parties consent to personal jurisdiction in those courts.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
16. Miscellaneous
- Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Lucid North regarding the Service.
- Severability: If any provision is held unenforceable, the remainder remains in effect.
- No Waiver: Failure to enforce any provision is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign freely.
- Notices: Notices to Lucid North must be sent to
support@song-zero.app. We may notify you via the email on your account. - Force Majeure: Lucid North is not liable for delays or failures caused by events beyond its reasonable control.
17. Electronic Communications Consent (E-SIGN / UETA)
By creating an account or using the Service, you consent to receive all communications, agreements, disclosures, notices, receipts, contracts, and records (collectively, "Communications") from Lucid North in electronic form, including by email to the address on your account, through the Service, or by in-app notification. This consent applies to all Communications between you and Lucid North relating to the Service for the duration of your account and any successor account.
To access and retain electronic Communications, you need: (i) a current desktop or mobile web browser; (ii) an active email account capable of receiving messages from @song-zero.app and @lucid-north.com domains and not blocking them as spam; (iii) the ability to view PDF and HTML documents; and (iv) sufficient storage to save Communications you wish to keep. If our hardware or software requirements change in a way that creates a material risk you may not be able to access prior Communications, we will notify you by email.
You may withdraw this consent and request paper copies by emailing support@song-zero.app. Because the Service is operated electronically, withdrawal of consent may result in termination of your account, and we may charge a reasonable per-document fee for paper records permitted by applicable law.
You agree that your assent — whether by clicking "I Agree," "Subscribe," "Confirm," or a similar button, signing in to your account, completing a Run, completing a payment, or continuing to use the Service after notice of changes — constitutes your electronic signature and has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. §§ 7001–7031), the Uniform Electronic Transactions Act (UETA) as adopted in your state, and any other applicable electronic signature laws.
